Terms & Conditions

Last updated: 27 September 2026  ·  Effective date: 1 October 2026

These Terms and Conditions (the “Terms“) govern your access to and use of the website originall.market, its related pages, services and the Digital Product Passport features accessible through it and through the ORIGINALLUXURY mobile application (together, the “Marketplace“), and any purchase you make through the Marketplace.

The Marketplace is operated by ORIGINALL SERVICES FZCO, trading as ORIGINALLUXURY, a free zone company registered in the Dubai Multi Commodities Centre (DMCC) Free Zone under licence number DMCC-943062 and registration number DMCC200210, with its registered address at Unit ALMAS48-LUX-SO-02, DMCC Luxury Innovation Centre, 48th Floor, Almas Tower, Plot JLT-PH1-A0, Jumeirah Lakes Towers, Dubai, United Arab Emirates (“ORIGINALLUXURY“, “we“, “us” or “our“). Our VAT Tax Registration Number (TRN) is 104755035300003.

By creating an account, placing an order or otherwise using the Marketplace, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy & Data Policy. If you do not agree, please do not use the Marketplace. Please pay particular attention to Section 9 (All Sales Are Final) and Section 15 (Limitation of Liability).

1. Definitions

  • “Maison” means an independent designer, jeweller, brand or other professional seller whose products are listed on the Marketplace.
  • “Product” means any piece of jewellery, gemstone, pearl or other item offered for sale on the Marketplace.
  • “Digital Product Passport” or “DPP” means the digital record associated with a Product, containing information about its design, materials, provenance, certification and ownership, as described in Section 10.
  • “Customer“, “you” or “your” means any person who browses the Marketplace, creates an account or places an order.
  • “Consumer” means a Customer acting for purposes outside their trade, business, craft or profession.

2. About the Marketplace

2.1 The Marketplace is a curated online marketplace presenting Products created by independent Maisons from around the world. Each Product is accompanied by its own Digital Product Passport.

2.2 Unless a Product page expressly states otherwise, the contract of sale for a Product is concluded between you and the Maison offering that Product. ORIGINALLUXURY operates the Marketplace, collects payment on behalf of the Maison as its commercial agent, coordinates the order and issues and transfers the Digital Product Passport. The Maison is responsible for preparing and shipping the Product. The identity of the Maison is shown on each Product page.

2.3 Maisons wishing to sell on the Marketplace are subject to a separate seller agreement with ORIGINALLUXURY. These Terms apply to Customers.

3. Eligibility and Accounts

3.1 You must be at least 18 years old and have full legal capacity to enter into binding contracts to create an account or place an order.

3.2 You agree to provide accurate, current and complete information and to keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that takes place under your account. Please notify us immediately at contact@originall.com if you suspect any unauthorised use.

3.3 We may suspend or close your account, or refuse service, where we reasonably believe that you have breached these Terms, provided false information, engaged in fraudulent or unlawful activity, or where we are required to do so by law.

4. Product Information

4.1 Product descriptions, images, specifications, certificates and DPP content are supplied primarily by the relevant Maison and, where applicable, by independent laboratories or other third parties. We take reasonable care in curating the Marketplace, but we do not independently verify every item of information supplied and we do not guarantee that it is complete or error-free, save as required by law.

4.2 Many Products are handmade and/or contain natural gemstones, pearls or precious metals. Natural variations in colour, clarity, size, shape, weight and finish are inherent characteristics of these materials and are not defects. Colours may appear differently depending on your screen settings.

4.3 Where a gemstone or pearl is accompanied by a grading report or certificate from an independent laboratory, that report is the opinion of the issuing laboratory at the date of issue. ORIGINALLUXURY is not responsible for the content of third-party reports.

4.4 All Products are offered subject to availability. Many pieces are unique or produced in limited quantities.

5. Prices and Payment

5.1 Prices are displayed in United Arab Emirates Dirhams (AED) and/or in such other currencies as we may offer on the Marketplace from time to time. You will be charged in the currency shown at checkout. Where a price is displayed in a currency other than your card’s currency, your card issuer may apply its own exchange rate and fees; any currency conversion shown for convenience is indicative only.

5.2 Prices include UAE Value Added Tax (VAT) where applicable. Unless expressly stated at checkout, prices do not include delivery charges, insurance, import duties, customs fees or local taxes in your country, which are shown at checkout or payable by you on import (see Section 8.5).

5.3 Payment must be made in full at the time of ordering using one of the payment methods offered at checkout. Payments are processed securely by our payment service provider, Stripe; we do not store your full card details. We may carry out payment authorisation, fraud screening and verification checks before accepting an order.

5.4 If a Product is listed at an obviously incorrect price due to a technical or human error, we are not obliged to supply the Product at that price. We will inform you of the error and give you the option to confirm the order at the correct price or cancel it, in which case any amount paid will be refunded in full.

6. Orders and Formation of Contract

6.1 Placing an order constitutes an offer to purchase the Product(s) in your basket. Before submitting your order you will have the opportunity to review it and correct any input errors.

6.2 After you place an order, you will receive an email acknowledging receipt. This acknowledgement does not mean your order has been accepted. A binding contract is formed only when we send you an order confirmation stating that the order has been accepted and/or dispatched.

6.3 We or the Maison may decline an order, before acceptance, for reasons including unavailability of the Product, a pricing or description error, failed payment authorisation, suspected fraud, inability to complete the verification checks described in Section 7, or restrictions on delivery to your destination. If an order is declined after payment has been taken, the full amount will be refunded.

6.4 These Terms, your order and the order confirmation are concluded in English. We will send you a copy of the order details by email; we recommend you keep a copy for your records.

7. Identity Verification, Anti-Money Laundering and Sanctions

7.1 Trade in precious metals and precious stones is subject to anti-money laundering (AML), counter-terrorist financing and sanctions laws, including those of the United Arab Emirates applicable to dealers in precious metals and stones. To comply with these obligations we may, before accepting or dispatching an order, request information and documents such as proof of identity, proof of address, and information on the source of funds.

7.2 We may delay, suspend or cancel an order, or decline to process a payment, where these checks cannot be completed to our satisfaction, where we reasonably suspect that a transaction is connected to unlawful activity, or where the transaction would breach applicable sanctions. Where required by law we may report transactions to the competent authorities and may be prohibited from informing you that we have done so.

7.3 We do not accept payment in cash. Accepted payment methods are those shown at checkout.

8. Delivery, Title and Risk

8.1 Products are prepared and shipped directly by the relevant Maison using insured, tracked carriers to the delivery address you provide. Shipping details and tracking information will be communicated to you once the Product has been dispatched. Delivery times shown are estimates and may vary, particularly for international shipments, made-to-order pieces and shipments subject to customs clearance.

8.2 A signature and/or proof of identity may be required on delivery. We cannot deliver to P.O. boxes or freight forwarders. Please make sure that your delivery address is accurate; we are not responsible for delays or losses resulting from an incorrect address provided by you.

8.3 Risk of loss of or damage to the Product passes to you upon delivery to you or to a person you have nominated to receive it. Ownership (title) of the Product passes to you upon delivery, provided payment has been received in full.

8.4 Please inspect the parcel on delivery. If the outer packaging is visibly damaged or tampered with, note this with the carrier where possible, and notify us within 48 hours of delivery with photographs at contact@originall.com.

8.5 For deliveries outside the United Arab Emirates, you are the importer of record and are responsible for any import duties, customs fees and taxes charged by the destination country, unless these are expressly included at checkout. You are responsible for ensuring the Product may lawfully be imported into your country. If a shipment is refused or returned because duties are not paid, the order remains final and return shipping costs may be deducted from any amount returned to you in accordance with Section 9.

9. All Sales Are Final

9.1 All purchases made on the Marketplace are final. Given the unique, high-value and frequently handmade or made-to-order nature of the Products, and the issuance and transfer of a personalised Digital Product Passport on purchase, we do not offer refunds, returns or exchanges for change of mind, incorrect size selection, or any other reason not set out in Section 9.3 below.

9.2 Once an order has been confirmed in accordance with Section 6.2, it cannot be cancelled by the Customer. Made-to-order, engraved, resized or otherwise personalised pieces are produced to your specifications and are final from the moment the order is confirmed.

9.3 Your statutory rights. Nothing in these Terms excludes or limits any right you have under mandatory law that cannot be excluded or limited by contract. In particular:

(a) Defective, damaged or non-conforming Products. If a Product you receive is defective, was damaged in transit, or does not materially correspond to its description (a “Non-Conforming Product“), please notify us within 7 days of delivery at contact@originall.com with your order number, a description of the issue and photographs. After inspection, and as required by applicable law, the Product will be repaired, replaced or, where repair or replacement is not possible, refunded. Please do not return a Product without first obtaining a return authorisation from us.

(b) Wrong item. If you receive a different item from the one you ordered, we will arrange for its collection at our cost and deliver the correct Product or, if that is not possible, refund the amount paid.

(c) Mandatory rights of withdrawal. If you are a Consumer habitually resident in a country whose law grants you a right to withdraw from a distance contract that cannot be excluded by contract, that right is not affected by this Section 9. For Consumers in the United Kingdom, the right of withdrawal is set out in Section 9.4.

9.4 Right of withdrawal for UK Consumers. If you are a Consumer and your Product is delivered to an address in the United Kingdom, you have the right to withdraw from the contract within 14 days without giving any reason, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

(a) Withdrawal period. The withdrawal period expires 14 days after the day on which you, or a person you nominate (other than the carrier), take physical possession of the Product. Where an order comprises several Products delivered separately, the period expires 14 days after the day on which you take possession of the last Product.

(b) How to withdraw. To exercise the right of withdrawal, you must inform us of your decision by a clear statement sent by email to contact@originall.com or by post to the address in Section 22, stating your name, address, order number and the date of delivery. You may use the model withdrawal form in Annex 1, but this is not obligatory. To meet the deadline, it is sufficient to send your notice before the withdrawal period has expired.

(c) Returning the Product. You must send back the Product, unworn and in its original condition and packaging, together with any certificates, grading reports, boxes and accessories supplied with it, without undue delay and in any event no later than 14 days after the day on which you notify us of your withdrawal. We will provide you with the return address of the Maison. You must bear the direct cost of returning the Product. Given the value of the Products, we strongly recommend an insured and tracked service, as the Product remains at your risk until it is received.

(d) Refunds on withdrawal. We will reimburse all payments received from you for the Product, including the standard delivery costs (other than any supplementary cost resulting from your choice of a delivery method more expensive than the least expensive standard delivery we offer), without undue delay and no later than 14 days after the day on which the Product is received back or you provide evidence of having returned it, whichever is earlier. We will use the same means of payment as you used for the initial transaction, unless you expressly agree otherwise; you will not incur any fees as a result of the reimbursement.

(e) Diminished value. You are liable for any diminished value of the Product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning (for example, wearing the piece, resizing or engraving it, or losing its certificate). We may deduct an amount reflecting that diminished value from the reimbursement.

(f) Exceptions. The right of withdrawal does not apply to Products made to your specifications or clearly personalised, including made-to-order, engraved, resized or bespoke pieces.

9.5 Any other refund due under this Section 9 will be made to the original payment method within 30 days of the Product being received and inspected, or within any shorter period required by law. On any refund, including a refund following withdrawal, the associated Digital Product Passport will be returned to the Maison and removed from your account.

10. Digital Product Passport

10.1 Each Product is accompanied by a Digital Product Passport accessible through the ORIGINALLUXURY mobile application and/or your account. On completion of your purchase and receipt of full payment, the DPP associated with the Product is transferred to your account.

10.2 The DPP brings together information about the Product, such as its designer, materials, gemstones, provenance, certifications and documents, as provided by the Maison and third parties. Unless expressly stated otherwise, the DPP is an informational record; it is not in itself a certificate of authenticity, a grading report, an appraisal or a valuation, and it is not a document of title.

10.3 You may add your own documents, photographs, valuations and other content to your DPP. You remain responsible for the content you upload, must have the right to upload it, and grant ORIGINALLUXURY a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content solely to provide the DPP service to you and to any person to whom you transfer the DPP.

10.4 If you sell or give the Product to another person, you may transfer the DPP to them through the application. Personal content you have added will not be transferred unless you choose to include it. You must not transfer a DPP separately from the Product to which it relates, or use a DPP to misrepresent a Product.

10.5 We aim to keep the DPP service available for the lifetime of the Product, but access depends on the continued operation of our systems and those of our technology providers. We will use reasonable efforts to give you advance notice and a means of exporting your DPP information should the service be discontinued.

11. Maison Responsibilities

Maisons are responsible for the accuracy of the information they supply, for the conformity of their Products with their descriptions and with applicable laws (including laws on hallmarking, precious metal standards, responsible sourcing, conflict minerals, the Kimberley Process for rough diamonds and CITES-regulated materials), and for honouring the statutory rights described in Section 9.3. ORIGINALLUXURY curates Maisons and may remove any listing or Maison that does not meet its standards.

12. Intellectual Property

12.1 All content on the Marketplace, including text, images, logos, trade marks, designs, the DPP format, software and the “ORIGINALLUXURY” and “OriginAll.Market” names, is owned by or licensed to ORIGINALLUXURY or the relevant Maison and is protected by intellectual property laws.

12.2 You may view and print content for your personal, non-commercial use only. You may not copy, reproduce, modify, distribute, scrape or commercially exploit any content without our prior written consent. The purchase of a Product does not transfer any intellectual property rights in its design.

13. Acceptable Use

You agree not to: use the Marketplace for any unlawful or fraudulent purpose; attempt to gain unauthorised access to our systems or other users’ accounts; introduce viruses or malicious code; use robots, scrapers or automated means to access the Marketplace; interfere with the security or operation of the Marketplace; purchase Products for the purpose of money laundering or sanctions evasion; or post content that is unlawful, defamatory, infringing or offensive.

14. Reviews and User Content

Where the Marketplace allows you to post reviews or other content, you confirm that the content is genuine, reflects your honest opinion and complies with Section 13. We may moderate, decline or remove content that does not comply with these Terms. We do not publish fake reviews, and we do not offer incentives for positive reviews.

15. Limitation of Liability

15.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law, including your statutory rights as a Consumer.

15.2 Subject to Section 15.1, the Marketplace is provided on an “as is” and “as available” basis, and ORIGINALLUXURY shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, goodwill or data, arising out of or in connection with the Marketplace or these Terms.

15.3 Subject to Section 15.1, the total liability of ORIGINALLUXURY in connection with any order shall not exceed the total price paid by you for that order.

15.4 ORIGINALLUXURY is not liable for the acts or omissions of Maisons, carriers, payment service providers, laboratories or other third parties, except to the extent required by applicable law or caused by our own breach of these Terms.

16. Indemnity

If you are not a Consumer, you agree to indemnify ORIGINALLUXURY against any claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Marketplace.

17. Events Beyond Our Control

We shall not be liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, epidemics, war, terrorism, civil unrest, strikes, failure of carriers or telecommunications networks, cyber-attacks, or acts of government. If such an event prevents delivery for more than 60 days, either party may cancel the affected order and any amount paid for undelivered Products will be refunded.

18. Privacy

We process your personal data in accordance with our Privacy & Data Policy, available at originall.market/privacy-policy, which forms part of these Terms.

19. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in law or in our services. The version in force at the time you place an order will apply to that order. We will notify registered users of material changes by email or through the Marketplace. The date of the latest update is shown at the top of this document.

20. Governing Law and Disputes

20.1 These Terms and any dispute arising out of or in connection with them are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai.

20.2 If you are a Consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you are habitually resident, and you may also bring proceedings in the courts of that country where the law so permits.

20.3 We encourage you to contact us first so that we can try to resolve any complaint amicably. We aim to respond to complaints within 10 days. Subject to Section 20.2, any dispute not resolved amicably within 30 days shall be submitted to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

21. General

  • Severability: if any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.
  • No waiver: failure to enforce any right does not constitute a waiver of that right.
  • Assignment: you may not transfer your rights under these Terms without our consent. We may transfer our rights to a successor entity, provided this does not reduce your rights.
  • Entire agreement: these Terms, the order confirmation and the Privacy & Data Policy constitute the entire agreement between you and us in relation to your order.
  • Language: these Terms and all contracts concluded under them are in English. Any translation is provided for convenience only, and the English version prevails.
